National Ordinance regulating the Post
The supervision on the postal sector is provided for by law in the National Ordinance regulating the Post 1998, (Official Gazette 1997, no. 319), the implementing regulations attached thereto and the Resolution for Concessions. The regulations, conditions, obligations and restrictive clauses that apply to the market providers in the postal sector are therein contained.
- The holder of the postal concession:
The postal company, Cpost International N.V., has a monopolistic position and is under obligation to deliver the formulated assigned postal services in the National Ordinance regulating the Post and the frameworks of the National Resolution for Concessions, from which the monopolistic position is derivedThe assigned services include:
- The transportation of letters up to 2,000 grams against a fee, with the exception of a registered courier or an exemption
- The installation of letter boxes or mailboxes by or on the public road for the public
- The issue of postage stamps and imprinted stamps containing the image of the King or Curaçao
- Registered courier services:
These may provide postal services, subject to the condition that the couriers are registered in accordance with the provisions as laid down in the Decree for the registration of courier services, (Official Gazette 2004, no. 65)and that they act accordingly. Besides this, there are three conditions in force for registered courier services, subject to which the provision of postal services is permitted:- Letters must weigh less than 2,000 grams and be delivered faster than by the postal company
- Letters must be traceable at all times
- Letters are transported by a registered courier against a rate higher than the minimum rate as determined in accordance with the National Resolution for minimum rates of courier services, (Official Gazette 2005, no. 3)
